The construction of a road connecting Polna Street with Kochanowskiego Street is an important element of the city’s infrastructure and a significant topic for a large group of residents, so large that there are attempts to manipulate information and present a distorted picture of the mayor’s investment activities.
From the information that could be read in the local press, it appears that officials from Myszków were acting slowly and were unable to cope with this construction. Such allegations are made by councilor Skorek-Kawka. It must be clearly stated that the councilor is mistaken in facts and concepts, and seems to not know exactly what she is talking about.
To clarify any misunderstandings, we present the facts.
The construction task is being carried out on the basis of an agreement from September 28, 2009. Therefore, it is obvious to everyone that the investment could not have started in 2008 without a proper agreement, as it would be illegal. Councilor Skorek-Kawka should be well aware of this fact. If she does not know, she should reconsider her presence in the Myszków City Council.
On September 1, 2008, the Starosta of Myszków issued a decision on the final determination of the location of the public-municipal road. Based on the final decision of the starosta, the Myszków Municipality became the owner of part of the real estate taken for the planned road, however, for adequate compensation. According to the law in force then, this unequivocally meant that the Municipality of Myszków would take over the lands for the planned investment only when final and legally binding decisions on compensation for the mentioned lands were issued. The decisions on compensation the Starosta of Myszków only started issuing in July 2010 and has not yet issued all decisions to this day. The councilor once again shows informational ignorance by not knowing or not wanting to know who and when issued the required legal decisions enabling the takeover of the land and commencement of works.
All construction works can only start after fulfilling the described conditions. Maintaining that the investment should have started 2 years ago with the takeover of the land by means of execution remains inconsistent with the current law. Such a possibility is only allowed by an amendment to the law, which has been in force since the end of 2008. However, the provisions in force at that time did not permit the initiation of this investment and the issuance of the starosta’s decision on the location of the public road. It is also puzzling that the city councilor is “encouraging” the enforcement solution, as if inviting the bailiff to the residents, instead of resolving the issue in accordance with the law and simply humanly through negotiations and the sequence of events, which was also done by the Municipality.
Mayor of Myszków, Janusz Romaniuk, importantly, did not wait with folded hands for the starosta to take a position. All project documentation was prepared, agreements and building permits were obtained, tender proceedings were conducted, and the investment itself was started. As part of the works, sanitary sewage was already installed in Strażacka and Polna streets, as well as rainwater sewage in Polna Street to Kamiennej Street. These were works carried out on municipal plots, works that could be carried out without breaking the law and waiting for the starosta’s decisions. It is worth reminding once again that entering construction works on plots that were not handed over to the municipality is a violation of the law.
Currently, in connection with resolving the issues enabling the conduct of works, on September 2, 2010, another section of the construction site was handed over to the contractors. The contractor has started to continue with the works.
Therefore, the investment is being implemented.
