Information – exchanging and invalidating personal documents.

The Department of Civic Affairs and Economic Records of the City of Myszków reminds about the applicable rules regarding the exchange and invalidation of identity cards.

Matters related to the exchange and invalidation of identity cards are regulated by the Act of October 3, 2008 amending the act on population records and identity cards, as well as certain other acts (Journal of Laws No. 1198, item 1198), which entered into force on January 1, 2009.

When do you need to exchange your identity card?
Article 40 of the act on population records and identity cards imposes an obligation on the holder of an identity card to exchange it in the following cases:
– change of data on the card – within 14 days of receiving the document confirming the change of data (for individuals residing abroad, the deadline is 3 months);
– damage to the identity card or other circumstances hindering the identification of the person – immediately;
– expiry of the validity period of the identity card – no later than 30 days before the expiry of the date.

When is the identity card invalidated?
The provisions of the act provide for the invalidation of the identity card by the issuing authority (the mayor, the town mayor, the city president) in the following cases:
– upon notification of the loss of the document, its destruction, or the date of transfer by a third party who found the identity card;
– upon loss of Polish citizenship by the holder of the card;
– upon the death of the card holder;
– upon receipt of a new identity card issued to replace the previous one;
– after 3 months from the date of data change appearing on the card (for individuals residing abroad, the deadline is 4 months).

It should be noted that individuals holding an invalid identity card may face difficulties in dealing with matters at offices, courts, or banks. Without a valid proof of identity, one cannot cross the border or get married at the civil registry office.

It is important to know:

– Loss of an identity card should be reported in person to the nearest municipal authority.
