Sandomierz, 7 March 2024 GN.683.3.12.2022 NOTICE Notification of the Sandomierz County Governor regarding the initiation of administrative proceedings to determine the amount of compensation for a property with unsettled legal status. Pursuant to the provisions of Article 61 § 1 and § 4 of the Act of 14 June 1960 – Code of Administrative Procedure (Journal of Laws of 2023, item 775), Article 12 par. 4a, 4f, and 5, Article 18, and Article 22 of the Act of 10 April 2003 on special principles for the preparation and implementation of investments in public roads (Journal of Laws of 2023, item 162 as amended) and Article 128 par. 1, Article 130 par. 2, Article 132 par. 1a, and Article 133 of the Act of 21 August 1997 on real estate management (Journal of Laws of 2023, item 344 as amended), the Sandomierz County Governor hereby notifies that from 10 June 2022 to 19 May 2022 it was made public by posting on the website of the County Governor’s Office in Sandomierz, on the website of the Public Information Bulletin of the County Governor’s Office in Sandomierz, on the Official Gazette website, and by posting on the notice board of the County Governor’s Office in Sandomierz, an announcement of the intention to determine the amount of compensation for a property with unsettled legal status located in the village of Beradz in the Klimontów commune, identified in the land register with plot numbers 289/1 and 320/1, with a total area of 0.0528 hectares. By decision AB.6740.12.2021.SPEC Decision 3/2022 of 15 March 2022, the Sandomierz County Governor allowed the implementation of a road investment by the municipal road administrator – the Mayor of the City and Municipality of Klimontów for the project of “Construction of a municipal road Beradz – Kolonia Łownica, with a length of 815 meters in the village of Beradz.” In accordance with Article 12 par. 4f of the Act of 10 April 2003 on special principles for the preparation and implementation of investments in public roads, compensation for properties occupied by roads, which by law have become the property of the municipality regarding properties occupied by a municipal road, is due to the previous owners, perpetual users, and individuals who hold limited property rights. Within 2 months from the date of publication and posting of the announcement, no persons entitled to property rights to the aforementioned property have come forward to the Sandomierz County Governor’s Office. At the same time, in accordance with the obligation arising from the provision of Article 10 § 1 of the Code of Administrative Procedure, it is notified that in this case, the evidentiary material has been completed. Parties may familiarize themselves with the case files and the evidence collected in the case. The documentation will be made available for inspection at the Real Estate Department of the Sandomierz County Governor’s Office, ul. Mickiewicza 34 (room No. 205, 2nd floor), from 7:30 AM to 3:30 PM, within fourteen days from the date of notification of this notice. After this period, an appropriate decision will be issued. Everyone whose personal data is processed has the right to lodge a complaint with the supervisory authority – the President of the Office for the Protection of Personal Data – if it is believed that the processing of personal data violates the provisions of the GDPR (Article 77 GDPR). 9. Personal data will not be processed in an automated manner, including profiling.
